Please read the following to learn more about how we collect, store, use and disclose information about you when you interact or use our websites (collectively the “Websites”) or any related events, trade shows, sales or marketing, and/or if you use any of our products, services or applications (collectively the “Services”) in any manner.

Welcome to the Slayer (“Slayer”, “us” or “we”) powered by Definitive Authentic (“Platform”) and administered by Inveniem, LLC (“Inveniem”) d.b.a Definitive Authentic in conjunction with slayerashownomercy.com and its associated terms, conditions privacy policy and DMCA. This Privacy Policy shall govern your use of the Platform or Service(s) without respect to whether you have a registered account or are simply browsing the offerings via a browser. This Privacy Policy covers the personal and other information that we may collect when you use the Platform or Service and which you choose to share with us (and, as applicable, our partners) so we can provide you with the best possible experience. If you do not agree with this Privacy Policy, then you are not eligible access the Platform or use any Service(s). By using the Platform or any Service(s), you are agreeing to Slayer, use and storage of certain information collected by us as further described hereinafter. If you access the Platform (or any features or Services offered through the Platform) via social media or other websites of any kind, then you may be required to accept and comply with additional privacy policies.

When you use the Services: We receive and store information you provide directly to us. For example, when setting up new users, we collect Personal Information, such as name and e-mail address, to provide them with Services. The types of information we may collect directly from our customers include name, username, email address, postal address, phone number, transactional information (including Services purchased), as well as any other contact or other information they choose to provide us or upload to our systems in connection with the Services.

When you use the Websites: When you visit the Websites, we collect certain information related to your device, such as your device’s IP address, referring website, what pages your device visited, and the time that your device visited our Website.

When you use the Services: Usage information: we keep track of user activity in relation to the types of Services our customers and their users use, and performance metrics related to their use of the Services.  

Log information: we log information about our customers and their users when you use one of the Services including Internet Protocol (“IP”) address. 

Information collected by cookies and other similar technologies: we use various technologies to collect information which may include saving cookies to users’ computers.

We will use the information we collect via our Websites:

Vendors, consultants, and other service providers:  We may share your information with third party vendors, consultants, and other service providers who we employ to perform tasks on our behalf.

If Slayer/Inveniem/Definitive Authentic have received your Personal Information in the United States and subsequently transfers that information to a third-party agent or service provider for processing, Slayer/Inveniem/Definitive Authentic shall remain responsible for ensuring that such third-party agent or service provider processes your Personal Information to the standard required by our Privacy Shield commitments (see the section below headed “International Data Transfers”). Unless we tell you otherwise and you consent, our vendors do not have any right to use the Personal Information we share with them beyond what is necessary to assist us.

Business Transfers: We may choose to buy or sell assets and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Protection of Slayer/Inveniem/Definitive Authentic and Others: We reserve the right to access, read, preserve, and disclose any information as necessary to comply with law or court order; enforce or apply our agreements with you and other agreements; or protect the rights, property, or safety of Slayer/Inveniem/Definitive Authentic, our employees, our users, or others.

Disclosures for National Security or Law Enforcement: Under certain circumstances, we may be required to disclose your Personal Information in response to valid requests by public authorities, including to meet national security or law enforcement requirements.

We use technical, organizational, and administrative security measures to protect all information we hold in our records from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.  Unfortunately, no company or service can guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information. California residents are entitled to ask us for a notice identifying the categories of Personal Information that we share with our affiliates and/or third parties for marketing purposes and providing contact information for such affiliates and/or third parties. Personal Information you submit on the Websites or through the Services is sent to the United States and will be primarily processed by us in the United States and potentially in other countries, on our servers or on our hosted service providers cloud servers on our behalf. We do not endorse any of these Linked Sites, the services or products described or offered on such Linked Sites, or any of the content contained on the Linked Sites. We do not knowingly collect or solicit personal information from anyone under the age of 16. If you are under 16, please do not attempt to register for the Services or send any Personal Information about yourself to us. If we learn that we have collected Personal Information from a child under age 16, we will delete that information as quickly as possible. This Privacy Policy covers our treatment of information that we gather when you are accessing or using our Websites or Services or when you contact us in any manner. We gather various types of information, including information that identifies you as an individual (“Personal Information”) from our users, as explained in more detail below.

We’re constantly improving our Websites and Services, so we may need to change this Privacy Policy from time to time as well. We will alert you to material changes by, for example, placing a notice on our Websites and/or by sending you an email (if you have registered your e-mail details with us) when we are required to do so by applicable law. Additional Privacy Policy information:

Slayer collects certain information from a User during different stages of use of the Platform or Service(s), as follows: (a) During Registration: Slayer collects: desired Username, e-mail address, certain information from Facebook® (if signing-in through Facebook®); Username and real name. (b) During Purchase: Slayer collects: billing information, first name, last name, address, credit card cumber (provided that such number is transmitted securely to Shopify Pay and the full credit card number is not stored on the Platform). (c) Shipping information: first and last name, address, city, state and zip code (d) During Sharing: Information from Facebook®, Username, real name, avatar (i.e., User picture), comments and/or link to share, photos (if attached to share) (e) Anonymous user data and information is collected Google Analytics from all Users without respect to whether they have a registered account or not via.

How information is used: (a) Information collected during registration is used internally within the Platform by us to: (i) identify a user to those applicable website administrators and moderators; (ii) facilitate a User being able to log-in; and (iii) notify a User via the provided e-mail of any changes which affect that User’s account. (b) Information collected during a purchase is used internally within the Platform and shared with Slayer’s fulfillment providers (e.g., Artist Endeavor, Shopify, Metro Pro, Boston Photo Imaging, Gooten, etc.) to: (i) calculate sales tax; (ii) charge the User for the applicable purchase; and (iii) send the User the purchased items. (c) Information collected during sharing is used internally within the Platform, displayed to other users, and displayed on Facebook®, to identify the User to other Platform users; enable the viewing of official pages on Facebook®, display to other Platform user’s official pages on Facebook® which the User has opted to publicly share.

How information is shared: We share your information with third parties as listed below and as otherwise described elsewhere in this Privacy Policy: (a) Service Providers: We may employ third parties to perform tasks on our behalf, such as payment processing, data management and analytics, marketing, communication, and IT services. We may need to share your Information with them in order for them to provide such products and services to you. These third parties do not have any right to use any of your information aside from what is necessary to assist us in providing such products and services (unless you have consented to such use). Use of your information by any of the aforementioned third parties shall remain subject to agreements that are consistent with this Privacy Policy as well as applicable law. (b) Affiliates: We may share your information with companies with whom we are affiliated or related to (e.g., parent company or subsidiaries). We shall require such affiliated or related companies to use your information solely in accordance with this Privacy Policy. We may choose to enter into types of transactions where our assets are sold or transferred. For the purpose of clarity and avoidance of doubt, User information is typically one of the business assets that would be sold or transferred. If Inveniem/Definitive Authentic is acquired or merges with another entity, then such User information will be one of the assets transferred. (c) With User’s Consent. Subject to your consent, we may share your Information with third-party businesses or sites that are not in our control. In those instances, your Information will be subject to their separate privacy policies, and it is your obligation to review those policies in advance before providing any consent to use your information.

Social Media and Weblogs: You can log in to the Platform using sign-in services such as Facebook® LogIn or an Open ID provider. Such services will authenticate your identity and provide you with the option to share certain personal information with us (such as name and email address) to pre-populate our sign-up form. When you sign in with Facebook®, we will receive only information in your public profile, your “friends” list, and your email address. Services like Facebook® LogIn give you the option to post information about your activities on the Platform to your profile page to share with others within your network. The Platform also offers publicly accessible blogs or community forums. You should be aware that any information provided in these areas may be read, collected, and used by other users who access them. To request removal of any user personal information from any blog or community forum, please contact Slayer at thesource@definitiveauthentic.com . In some cases, we may not be able to remove your personal information, in which case we will let you know if Slayer is unable to do so and why. Finally, the Platform includes “Social Media Features” (i.e., Facebook® and Twitter® buttons) and “Widgets” (i.e., the “Share This” button or interactive mini programs). These Social Media Features and Widgets may collect your internet protocol address, which page you are visiting on the Platform, and may set a cookie to enable the Social Media Features to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on the Platform. Your interactions with these Social Media Features and Widgets are governed by the privacy policy of the company providing them.

Security: You must prevent unauthorized access to your account by protecting your password. You should never share your password or use a password that has been used on other sites. Notwithstanding the foregoing, we reserve the right to access, preserve, and disclose any information that is reasonably believed to be necessary to comply with law or court order; enforce or apply our conditions of use and other agreements; or protect the rights, property, interests, or safety of Slayer and Inveniem / Definitive Authentic (including employees, users, or other entities).

Opt Out: Users always have the right to opt out of disclosing personal or other information and Users can disable certain tools on your browser or device prior to access the Platform and/or Service(s); provided, however; any opt out of any kind may affect a User’s ability to fully access the Platform or use the Services. Users may also be able to add, update, or delete any information; provided, however: that Inveniem / Definitive Authentic may retain a copy of the original information for our own business purposes such as analysis of aggregated anonymous data regarding past use of the Platform.

Changes, Amendments and Updates to the Privacy Policy: We reserve the right to update, change or amend this Privacy Policy at any time, in our sole discretion. Slayer of any information is subject to then current version of the Privacy Policy in effect at the time such information is collected. In the event that we make any material change to the Privacy Policy Users will be notified by way of an announcement posted on the Platform or by notification via that contact information that you included in his or her account prior to the updates or amendments becoming effective. We will also use a “last modified” date at the end of this Privacy Policy. You are required to continually check this page for any changes, updates, or amendments to this Privacy Policy. Notwithstanding the foregoing, you shall be bound to any changes, updates, or amendments to this Privacy Policy whenever you access the Platform or use any of the Service(s) following the posting of the respective change, update or amendment. Users who are residents of California have further rights under this Privacy policy pursuant to California’s Civil Code Sections 1798.83-1798.84 (“Shine the Light Law”). If you are a California resident, then you have the right to request a statement from us which identifies all types of personal Information that is shared with affiliates or third-parties for the purposes of marketing (“Information-Sharing Disclosure”). If you desire a copy of the Information-Sharing Disclosure, you must submit a written request to thesource@definitiveauthentic.com. Information-Sharing Disclosures may be requested no more than once per each year.

Disclaimer: User information is kept secure to current industry standards, but security can be breached, especially if Users are not diligent in the protection of accounting log-in information (e.g., username and password). While Users can modify their information via the applicable account settings, Slayer may retain User information in the aggregate and on a non-personally-identifiable basis for bona fide business purposes even if you are no longer a registered user. While Inveniem / Definitive Authentic works extremely hard to protect the privacy of our Users and all other information we retain, no one can guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of User information at any time.
